Terms of Service

1. Acceptance of Terms

By accessing or using RecruiterDesk ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

RecruiterDesk is a cloud-based applicant tracking system (ATS) designed for recruitment consultancy firms. It enables recruiters to manage candidates, job postings, clients, interviews, follow-ups, and placements. The Service is available globally via the web.

3. Eligibility

You must be at least 16 years of age to use this Service. By using RecruiterDesk, you represent that you meet this requirement.

4. Accounts and Access

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must provide accurate information when registering. Impersonation or false registration is prohibited.
  • Each company account ("tenant") has its own isolated data space. Recruiters within a company can access that company's data only.
  • You must notify us immediately if you suspect unauthorized access to your account.

5. Acceptable Use

You agree not to use RecruiterDesk to:

  • Store or share data in violation of any applicable law, including data protection laws
  • Upload candidate data without a lawful basis for processing (e.g. candidate consent or legitimate interest under your local law)
  • Send unsolicited bulk emails (spam) through the email integration
  • Attempt to access other tenants' data or reverse-engineer the platform
  • Use the Service for any unlawful, discriminatory, or harmful recruitment practices
  • Introduce malware, viruses, or harmful code

6. Candidate Data and Compliance

You are the data controller for any candidate or client data you upload to RecruiterDesk. You are responsible for ensuring that:

  • You have a lawful basis for collecting and processing candidate personal data
  • Candidates are informed about how their data is used
  • You comply with applicable data protection laws in your jurisdiction (e.g. GDPR, PDPA, CCPA)

RecruiterDesk acts as a data processor on your behalf for candidate data. See our Privacy Policy for details.

7. Gmail Integration

The optional Gmail integration allows RecruiterDesk to scan your Gmail inbox for resume attachments and to send emails on your behalf. By connecting your Gmail account:

  • You authorize RecruiterDesk to access Gmail data only for the stated purposes
  • You can revoke access at any time from the Settings page or from your Google Account
  • RecruiterDesk's use of Gmail data complies with the Google API Services User Data Policy, including the Limited Use requirements

8. Intellectual Property

RecruiterDesk and its underlying software, design, and branding are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the platform without our written consent.

You retain ownership of all data you upload to the Service (candidate profiles, resumes, job postings, etc.).

9. Service Availability

We aim to keep RecruiterDesk available at all times but do not guarantee uninterrupted access. We may carry out maintenance, updates, or experience outages. We will attempt to provide reasonable notice for planned downtime.

10. Limitation of Liability

To the maximum extent permitted by law, RecruiterDesk is provided "as is" without warranties of any kind. We are not liable for:

  • Loss of data due to user error, third-party failures, or service outages
  • Indirect, incidental, or consequential damages arising from use of the Service
  • Placement outcomes, hiring decisions, or recruitment results

Our total liability to you in any month shall not exceed the amount you paid to us in that month (or, if the service is free, zero).

11. Termination

We may suspend or terminate your account if you violate these Terms, abuse the platform, or engage in illegal activity. You may close your account at any time by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by applicable law. Disputes shall be resolved through good-faith negotiation; if unresolved, through binding arbitration or the courts of the jurisdiction where the company operating RecruiterDesk is registered.
